
Introduction
Apizeal makes it easy for its users and their clients to add a legally binding electronic signature to authenticate and validate electronic documents, providing a secure and legal alternative to handwritten signatures. Therefore, Apizeal integrates the electronic signing capability for our users’ clients, so that from the Apizeal portal, online, quickly and seamlessly, users can create their own documents or use pre-established templates and obtain the electronic signature, consumer consent for enrollment in the health market, and more.
Apizeal is committed to protecting privacy and ensuring that personal data and electronic signatures are handled with the utmost security and in accordance with the law. This disclosure document explains how personal information and electronic signatures are collected, used, and protected in the context of the security and legality of electronic transactions and communications, such as agreements, forms, contracts, consents, and others that users may create according to their needs.
From time to time, the law may require Apizeal to provide certain notices or disclosures to you in writing. The terms and conditions for providing such notices and disclosures electronically through the Apizeal E-sign system are described below.
1. Collection and Use of Personal Data
We collect personal information necessary to complete electronic documents. This includes, but is not limited to, name, address, contact information, and any other relevant information.
2. Electronic Signature
The electronic signature obtained through our portal has the same legal validity as a handwritten signature, in accordance with the United States Electronic Signatures in Global and National Commerce Act (E-SIGN Act), which establishes that electronic signatures on documents have the same legal validity as paper signatures. The Apizeal E-sign electronic signature process is designed to ensure its authenticity and security.
3. HIPAA Compliance
Since users register sensitive personal data through the Apizeal Portal in the context of the health insurance market, Apizeal strictly complies with the requirements of the Health Insurance Portability and Accountability Act (HIPAA) regarding the security and privacy of protected electronic information in legal disclosure.
4. Obtaining Paper Copies
If you are not a direct Apizeal customer and wish to receive printed copies of the document containing your signature, you must request a printed copy of your documents directly from your agent or broker, which will be sent to the address you provided for such purposes. If you are an Apizeal user and wish to receive printed copies of these documents, an additional fee per page will be charged. You can request the delivery of such paper copies by following the procedure described below:

5. Withdrawing Your Consent to Receive Electronic Notices and Disclosures
If you are not a direct Apizeal customer and decide to receive notices and disclosures electronically, you can also change your mind at any time and let your agent, agency, or broker know that you wish to receive the required notices and disclosures only in printed format.
6. Consequences of Changing Your Mind
If you choose to receive the required notices and disclosures only in paper format, it will slow down the process by which your agent, agency, or broker completes certain steps to provide you with the service, as they will first need to send you the required notices and disclosures in paper format and then wait until they receive your acknowledgment of receipt of such paper notices or disclosures. Additionally, you will no longer be able to use the Apizeal E-sign system to receive required notices and consents electronically or to sign documents electronically.
7. All Notices and Disclosures Will Be Sent to You Electronically
Unless you indicate otherwise according to the procedures described in this document, all notices, disclosures, authorizations, acknowledgments, and other required documents that must be provided or made available to you during the course of your relationship with Apizeal will be provided electronically through the Apizeal E-sign system. To reduce the possibility of you inadvertently not receiving any notice or disclosure, it is suggested to receive all required notices and disclosures by the same method and to the same address you provided. This way, you can receive all disclosures and notices electronically or in paper format via the postal delivery system if you so decide. If you disagree with this process, please let your agent, agency, or broker know. Also, refer to the previous paragraph describing the consequences of your choice not to receive electronic notices and disclosures.
8. Responsibilities
The agent, agency, or broker is responsible for receiving notification from their client about changes in their email address. If you are an Apizeal user, ensure that you remind your clients to keep you informed of changes to update the email address where electronic notices and disclosures will be sent.
9. To Withdraw Your Consent with Apizeal
If you are an Apizeal user, you should know that the Apizeal E-sign system is an optional tool, so you can decide whether to use it voluntarily. It is a service that you can stop using at any time, and you will no longer receive future notices or disclosures in electronic format. 10. Necessary Hardware and Software
The minimum system requirements to use Apizeal E-sign may change over time, and only a device with internet access is needed.
11. Acknowledgment of Your Access and Consent to Receive and Sign Documents Electronically
To confirm that you can access this information electronically, which will be similar to other electronic notices and disclosures that will be provided to you, you must confirm and ensure that:
- You have read this (DERS); and
- You can print on paper; or
- Electronically save this (DERS) for future reference and access; or
- You can email this (DERS) to an email address where you can print it on paper or save it for future reference and access.
